Probably up to 90% of them are pirating the games anyway, Nintendo probably figured out they do not need the hassle anyway...

So, Nintendo eShop doesn't sell games or content, but are offering a contract to access them. The soon as the contract is broken, you cannot access to games or content again outside, let's hope, the ones stored on your console. It's pretty sad to see that most companies keep confusing selling and renting, buying and owning, users and milking cows.

Cows have no say in their role (unfortunately). You have a choice to read user agreement, and to not pay when having doubts
